Terms of Use
Plain terms for an information service. Version 2026-08-01-payments.
Development-only contract. The contracting-party identity and address are not configured. No payment may be taken until they are supplied and these terms are reviewed for every market in which the service will be sold.
1. Who these terms are with
The public seller is not yet configured. Access is limited to a no-charge development pilot.

By using the service you agree to these Terms. Unlocking a development report requires a separate acknowledgement. If you do not agree, do not use or unlock the service.
2. What Waterlogged provides
Waterlogged provides river observations, official forecast distributions where available, transparent model scenarios, source links and dated research summaries. It is an independent information service, not a cruise operator, travel agent, insurer, broker, claims handler, lawyer, financial adviser, hydrological authority or navigation service.
Current-state route assessments are not forecasts of operator conduct. Operator-document and consumer-law sections are research commentary, not contract or legal interpretations. Money calculations are illustrative scenarios, not entitlements, valuations or recommendations.
Cruise-specific scenarios and forecast updates are published daily only for departures in the next three calendar months. Live gauge observations may change between daily publications and remain separately labelled observations, not a promise that a cruise-specific report has been refreshed or that the displayed level will persist to departure.
3. Your responsibility
Use the service as one input for questions and verification. You are responsible for checking current operator communications and the documents attached to your booking before acting. Do not rely on Waterlogged alone to book, cancel, rebook, change coverage, make a claim, incur expense or move a vessel. Obtain qualified advice where the financial or legal consequence is material.
4. How a purchase is made
The current checkout is simulated: it takes no card details, uses no payment processor and charges nothing. It writes a signed access cookie to this browser. Displayed prices are product tests, not completed sales.
When payment is enabled, an order placed at checkout will be your offer and the contract will be formed on confirmation of payment, on the version of these Terms shown and acknowledged at that checkout — which is recorded against the order. One report, one sailing, one price; nothing renews. The Refund Policy (full refund within 7 days) will form part of those Terms and is published in advance.
Before real payment is enabled, the checkout must present the seller identity, complete price and currency, service description, delivery timing, renewal and cancellation terms, refund policy, and any mandatory local disclosures, and provide a retainable contract copy. Paid terms presented then will govern that purchase; a recurring service will not be started by this pilot.
5. Sources, changes and corrections
Sources may be revised, delayed, unavailable or withdrawn. Models, thresholds, source coverage and summaries may change when evidence changes. Material model changes are recorded on the methodology change page. Waterlogged may withdraw an assessment when required inputs are missing and may correct a report without notice. Source licences and credits are listed under Limits & data sources.
6. Personal-use licence
You may read, download and print a report for your personal travel planning and share it with people helping with that booking. You may not resell reports, bulk-scrape the service, remove source credits, imply authority or operator endorsement, or use the service to operate a vessel. Authority data remains subject to its source licence; Waterlogged's selection, analysis and presentation remain protected to the extent permitted by law.
7. Warranty and liability limits
To the extent permitted by law, the pilot and reports are provided “as available” without a promise that they are complete, current, uninterrupted or suitable for a particular decision. Waterlogged is not responsible for an operator's decisions, source errors, or losses caused by treating a scenario or summary as a guarantee or professional opinion.
To the extent permitted by law, Waterlogged will not be liable for indirect, consequential or special loss, or loss of profit, opportunity or enjoyment. For claims directly arising from a paid Waterlogged service, aggregate liability is limited to the fees you paid for the affected service in the preceding 12 months. These limits do not apply where prohibited, including to liability that cannot lawfully be limited, and they do not remove mandatory consumer rights. Nothing here excludes liability for fraud, wilful misconduct or gross negligence where such an exclusion would be unlawful.
8. Governing law, disputes and time limits
These Terms are governed by the laws of Ontario, Canada and the federal laws of Canada that apply there, without taking away any mandatory protection or forum available under the law that applies to you. The parties submit to the courts of Ontario, Canada, and nothing in this paragraph prevents you from bringing a claim in a court that the law of your own country of residence entitles you to use.
Time limit. Any claim arising out of these Terms or a paid Waterlogged service must be brought within 12 months of the date the claim first arose, after which it is waived to the extent the law allows. Where a longer period is required by law and cannot be shortened by agreement, that longer period applies instead of this one.
No arbitration. These Terms do not require arbitration and do not waive participation in a class proceeding. Contact us first so a data, billing or document error can be investigated — most of what reaches us is a source correction, and it is faster to fix than to argue about.
9. Changes and contact
The version date identifies these Terms. A material change will be posted before it applies to future use; terms accepted for a completed purchase will not be silently replaced for that purchase. Privacy handling is described separately in the Privacy Notice.
